This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit kindcloudsolutions.com (the “Website”), communicate with us, request or purchase our services, or otherwise interact with products and services that link to this Privacy Policy (collectively, the “Services”).

This Privacy Policy also explains the privacy choices and rights that may be available to you.

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to personal information that Kind Cloud Solutions collects or processes for its own business purposes.

In some circumstances, Kind Cloud Solutions processes personal information on behalf of a business customer under that customer’s instructions. In those circumstances, the customer generally determines the purposes and means of processing and Kind Cloud Solutions acts as a service provider or processor. The customer’s privacy policy, agreement, or other applicable notice governs that processing. If you have a request concerning personal information that we process solely on behalf of one of our customers, you should generally direct your request to that customer.

This Privacy Policy does not apply to third-party websites, products, applications, or services that may be linked to or integrated with our Services and that maintain their own privacy practices.

Some Services may use artificial intelligence, machine learning, automated workflows, or third-party AI technologies.

Information submitted to these Services may be transmitted to technology providers that process information on our behalf or as otherwise disclosed for the applicable Service.

Kind Cloud Solutions does not represent that AI-generated output will always be accurate, complete, or appropriate. Users should independently evaluate AI-generated information before relying upon it for consequential decisions.

Where required by applicable law, we will provide additional notice or obtain consent before using personal information for automated decision-making or profiling that produces legal or similarly significant effects.

Our use of customer information with third-party AI providers is also subject to applicable customer agreements, configurations, and provider terms.

With Your Direction or Consent

We may disclose information when you direct us to do so or otherwise provide authorization.

6. SALE, SHARING, AND TARGETED ADVERTISING

Kind Cloud Solutions does not sell personal information for monetary consideration.

Certain privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough that some advertising or analytics technologies may qualify even when no money is exchanged.

If Kind Cloud Solutions engages in activities that constitute a sale, sharing, or targeted advertising under applicable privacy law, we will provide any legally required notice and method for opting out.

Where required by applicable law, we will also recognize qualifying browser-based opt-out preference signals, such as Global Privacy Control, for the browser or device from which the signal is received.

We do not knowingly sell or share the personal information of children in violation of applicable law.

7. SENSITIVE PERSONAL INFORMATION

We seek to limit the collection of sensitive personal information to what is reasonably necessary for legitimate business purposes.

Depending on the Services involved, information supplied to us could contain information treated as sensitive under applicable law. We process sensitive personal information only for lawful purposes and obtain consent where applicable law requires it.

Please avoid providing sensitive information that is unnecessary for the Service you are requesting.

8. DATA RETENTION

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to:

Backup systems may retain copies for a limited period after information is removed from active systems.

9. DATA SECURITY

We maintain administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, acquisition, alteration, disclosure, loss, destruction, or misuse.

Depending on the circumstances, these measures may include access controls, authentication, encryption, logging, monitoring, network security, vulnerability management, employee or contractor controls, and incident-response procedures.

No information system, network, storage system, or method of Internet transmission can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of personal information.

10. YOUR PRIVACY RIGHTS

Depending on where you reside and applicable law, you may have some or all of the following rights concerning your personal information:

Please include sufficient information for us to understand your request.

We may need to verify your identity before completing certain requests. Verification information will be used for that purpose.

Where permitted by applicable law, you may use an authorized agent to submit certain requests on your behalf. We may request evidence that the agent is authorized to act for you and may also require you to verify your identity directly.

We will respond within the timeframe required by applicable law. Certain requests may be subject to exceptions or limitations.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

11. CALIFORNIA PRIVACY RIGHTS

If the California Consumer Privacy Act, as amended (“CCPA”), applies to our processing of your personal information, California residents may have additional rights concerning personal information, including rights to know/access, correct, delete, and obtain information concerning categories of personal information collected and disclosed, and to opt out of qualifying sales or sharing.

The categories of personal information we may collect are described in Section 2. The business and commercial purposes for collecting and using that information are described in Section 3. The categories of recipients to whom information may be disclosed are described in Section 5.

We do not sell personal information for money.

If our practices constitute “selling” or “sharing” under the CCPA, California residents may exercise the applicable opt-out right as described in Section 10 or through a privacy-control mechanism we make available.

Where required, we honor qualifying opt-out preference signals such as Global Privacy Control.

We do not use or disclose sensitive personal information for purposes requiring a right to limit under the CCPA unless otherwise disclosed.

12. OTHER U.S. STATE PRIVACY RIGHTS

Residents of states with applicable comprehensive privacy laws may have rights in addition to or differing from those described above.

Depending on applicable law, these may include residents of states such as Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other jurisdictions that adopt comprehensive consumer privacy legislation.

We intend to process valid privacy requests in accordance with the law applicable to the requesting consumer and will update our practices as privacy laws develop.

Nothing in this Privacy Policy is intended to restrict rights granted to you by applicable law.

13. INTERNATIONAL USERS AND DATA TRANSFERS

Kind Cloud Solutions is based in Hawaiʻi, a territory administered by the United States as the State of Hawaii, whose political and legal status remains the subject of historical and legal dispute, including claims concerning the continuing sovereignty of the Hawaiian Kingdom.

If you access our Services from outside the United States, your personal information may be processed in the United States or other countries in which we or our service providers operate.

These countries may have data-protection laws that differ from those in your jurisdiction.

Where applicable law requires a particular mechanism for transferring personal information internationally, we will use an appropriate lawful transfer mechanism.

Individuals located in jurisdictions such as the European Economic Area, United Kingdom, or Switzerland may have additional rights under applicable data-protection law, including rights concerning access, correction, deletion, restriction, objection, portability, and withdrawal of consent.

Where applicable, you may also have the right to lodge a complaint with your local data-protection authority.

14. LEGAL BASES FOR PROCESSING

Where laws such as the European Union General Data Protection Regulation, United Kingdom GDPR, or comparable laws require us to identify a legal basis for processing personal information, we may rely on one or more of the following:

  • performance of a contract or steps requested before entering a contract;

  • our legitimate interests, where those interests are not overridden by applicable privacy rights;

  • compliance with legal obligations;

  • protection of vital interests; or

  • your consent.

The applicable legal basis depends on the circumstances and purpose of processing.

15. CHILDREN’S PRIVACY

Our Services are intended primarily for businesses and adults and are not directed to children.

We do not knowingly collect personal information online from children under 13 in a manner subject to the Children’s Online Privacy Protection Act (“COPPA”) without complying with applicable parental notice and consent requirements.

If you believe a child has provided personal information to us inappropriately, please contact us at privacy@kindcloudsolutions.com so that we can investigate and take appropriate action.

Additional age-related protections may apply under state, federal, or international law, and we will comply with those requirements where applicable.

16. THIRD-PARTY LINKS AND SERVICES

Our Website or Services may contain links to, integrate with, or enable interactions with third-party websites, platforms, applications, or services.

We do not control the privacy practices of independent third parties. Their collection and use of information are governed by their own privacy policies and terms.

We encourage you to review those policies before providing personal information to a third party.

17. EMAIL AND MARKETING COMMUNICATIONS

You may opt out of promotional email communications by using the unsubscribe mechanism included in applicable messages or by contacting us.

Even if you opt out of marketing communications, we may continue sending non-promotional communications relating to active Services, transactions, security, legal notices, or your business relationship with us.

18. DO NOT TRACK

Some browsers offer a “Do Not Track” setting. Because there is not a universally accepted standard governing all responses to traditional Do Not Track signals, our Website may not respond to those signals.

Where required by applicable privacy law, however, we will recognize qualifying universal opt-out mechanisms such as Global Privacy Control for applicable processing.

19. DATA BREACHES AND INCIDENT RESPONSE

We maintain processes designed to identify, investigate, contain, and respond to security incidents.

If a security incident involving personal information triggers a notification obligation under applicable law, we will provide required notifications to affected individuals, customers, regulators, or other parties as required.

20. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy periodically to reflect changes in our Services, technology, business practices, or legal requirements.

When we update the Privacy Policy, we will revise the “Last Updated” date above.

If we make material changes, we may provide additional notice where appropriate or required by applicable law.

We encourage you to review this Privacy Policy periodically.
